Insurance by Contractor:

318 Tree Service, LLC. is insured for liability resulting from injury to person(s) or property and all employees are covered by

Workers’ Compensation as required by law. Certificates of coverage are available upon request.

Scheduling/Cancellation Fee:

318 Tree Service, LLC. kindly requests that the authorizing party provide at least 24-hours advance notice of any full or

partial work cancellation for jobs that have been scheduled in advance. If a crew has been dispatched to the job site for

scheduled work, and the customer cancels the job or job is already complete upon our arrival the customer will be assessed a mobilization fee of $500 for incurred expenses.

Completion of Contract:

318 Tree Service, LLC. agrees to do its best to meet any agreed upon performance dates, but shall not be liable in

damages or otherwise for delays because of inclement weather, labor, ground conditions, storm emergency or any

other causes beyond its control.

Ownership:

The authorizing party warrants that all trees listed are located on the customer’s property, or that the authorizing

party has received full permission from the owner to allow 318 Tree Service, LLC. to perform the specified work.

Should any tree be mistakenly identified as to ownership, the customer agrees to indemnify 318 Tree Service, LLC.

for any damages or costs incurred from the result thereof. 

Permission:

In the event access to a client’s neighbor’s property is needed to complete the requested tree services, it is the responsibility of the 

client or authorizing party to obtain written permission from the neighbor. If permission is needed it will be indicated on the proposal. 

Safety:

318 Tree Service, LLC. warrants that all arboricultural operations will follow the latest version of the ANSI Z133.1

industry safety standards. The authorizing party agrees to secure pets/animals and to not enter the work area during

arboricultural operations unless authorized by the crew leader on-site.

Stump Removal:

Stumps can be removed by utilizing a commercial stump grinder to remove stumps to depths of 4”-8” below grade

unless otherwise stated in the proposal. Stump removal is only included if requested. The hole created will be backfilled with the debris generated from grinding

and spread evenly to grade. Stumps containing foreign material (i.e. metal, concrete, etc) will not be ground. In the event stump grinding may not be completed due to foreign

material it is at the discretion of 318 Tree Service if invoiced amount will be adjusted.

Tree Decline or Failure:

318 Tree Service, LLC. will make customers aware of any problems found with trees while on property. It is

impossible to know or identify all problems and predict all failures. We will give our best professional opinion of structural stability

and tree health based on visual inspection. Customer acknowledges 318 Tree Service, LLC. is not responsible for

any decline in tree health or failure of tree or damage caused by failure of any or all of the tree after our work is. completed.

Debris Removal:

All work-related debris shall be reasonably cleaned up each day before the work 

crew leaves the site, unless otherwise coordinated by the client and crew leader. All lawn areas shall be raked, street

and sidewalks shall be swept, and all work related brush, branches and logs shall be removed from the site at job completion. Roofs shall be cleared of work related

debris only.  When clean-up is completed, some small twigs, fruit, leaves and excess sawdust may remain. 

Duty of Care:

318 Tree Service uses precaution to ensure our work practices do not cause harm to neighboring properties. We take reasonable steps to prevent sawdust

and/or foliage from blowing onto neighboring property (directing saw dust away from neighboring property, assigning crew member to consistently skim pools for debris/dust,

using barrier,etc). In the event neighboring properties refuse access to 318 Tree Service for these preventative measures 318 Tree Service is not liable for any damages or clean up.

Animals or Insects:

Many trees are a home to various animals or insects such as bees. In the event where previously unknown animals

or insects cause a safety concern we will require the homeowner to pay for additional time required to deal with the

problem. In the event the animal and/or insect is a protected species homeowner will be required to coordinate

removal of animals and/or insects. An adjusted invoice will be submitted to the homeowner and/or authorizing party.

Concealed Contingencies:

Any additional work or equipment required to complete the work, caused by previously unknown foreign material in

the trunk, the branches, underground, or any other condition not apparent in estimating the work specified, shall be

paid for by the customer on a time and material basis. 318 Tree Service, LLC. is not responsible for damages to

underground sprinklers, drain lines,invisible fences or underground cables unless the system(s) are adequately and

accurately mapped by the authorizing party and a copy is presented before or at the time the work is performed.

Driveways/Sidewalks:

318 Tree Service, LLC. will attempt to minimize any damage to driveways and sidewalks. If there is a problem that is

unknown such as a void area under concrete, or thin spots which cause a failure under the load of our equipment.

We are not responsible for this damage. If any damage is caused from falling debris as a result of our work, we will

take responsibility and correct the damage to the customers satisfaction- unless expected damage is outlined in the proposal.

Lawn & Surface Repair:

318 Tree Service,LLC. will attempt to minimize all disturbances to the customer’s lawn and surfaces. It is normal to have some dents in the yard during tree

work/stump grinding as a result of falling wood and equipment use. This is especially true during removals or wet   conditions. It is also normal to have temporary damage to turf

grasses from cleanup activities. If the customer finds this unacceptable we can take additional measures to decrease the amount of damage that will occur. This will add labor costs

to the job and must be specified in the estimate or it will be billed in addition. If there is any permanent root damage to turf or perennial beds or any ruts are made in the lawn from

our equipment, we will repair damage to the customer's satisfaction.

Fence Damage:

In the event fences and/or gates must be removed to allow access to the requested tree work 318 Tree

Service,LLC. makes a reasonable effort to remove and reinstall fencing to the condition it was found. In the event

the fencing material is in poor condition it will be the responsibility of the owner to replace the portions that are not

able to be reinstalled by 318 Tree Service,LLC. Any fence damage due to falling debris will be repaired/replaced at 318 Tree Service cost unless otherwise noted

in estimate.

Acceptance:

The client shall indicate acceptance of the Terms of the Service Agreement by either (a) Accepting the proposal via quickbooks               

(b) signing the proposal (c ) indicate acceptance via text or email (d) signing the Terms of Service Agreement (e) verbal acceptance of estimate

Withdrawal:

318 Tree Service reserves the right to withdraw their bid and services on any job at any time. If partial services are performed an adjusted invoice will be issued to the client. 

Additional Work:

Any additional work not outlined in the accepted proposal must be contracted separately either as a new proposal or as a written amendment to an existing agreement/proposal. The client

cannot request additional work from 318 Tree Service crew directly. Clients shall contact the 318 Tree Service office to arrange for any additional work. Failure to contact

318 Tree Service office for additional work not outlined proposal/agreement may result in additional fee rates at $650/hour.  

Work Modification:

Any modification or change to the approved proposal shall be deemed an amendment to the approved proposal, and any such  modification or change must be in writing.

An email or text from the client and acknowledged by 318 Tree Service shall be considered a writing under this agreement. However, under no circumstance shall a verbal

conversation be considered as a modification or change to the proposal. 

Barriers to Service Work Area:

318 Tree Service will identify any barriers to service that must be removed during or prior to the scheduled service date. Barriers may include fencing, vehicles, utility lines, decor etc.

These barriers will be outlined in the estimate. Failure to comply may result in additional cost to estimate services. 

Job Urgency:

In the event an estimate is provided for routine tree services and the customer requests the job be performed as an emergency please 

note our licensed Arborist has to deem it an emergent situation and an additional fee of no less than $500 will be added to the current estimated price. An updated estimate will be

provided to the customer for approval.

     Terms of Payment:

            Unless otherwise noted in this proposal, the customer agrees to pay the account in full upon completion of the work.

Failure to remit full payment within 10 days will result in a finance charge of 1% per day. 

Types of Payment:

Checks, Money Orders, Cashier’s Check or Cash.Credit Card Payments are accepted but must be requested by

Authorizing party and will be assessed a 3% convenience fee. 

Waiver of Liability of Additional Damage Due to Dead Tree Removal:                                                                                 

318 Tree Service will make every reasonable effort to prevent any additional damage to structures from falling debris. However, due to the decline and decay of the requested dead

tree removal 318 Tree Service will not be   liable for any of the following damages that may occur during removal:

  • Building Structures

  • Fences

  • Concrete/Brick 

  • Ornamental Structures

  • Etc. To be Outline in Estimate

Waiver of Liability of Additional Unavoidable Damage:                                                                                                         

318 Tree Service will make every reasonable effort to prevent any additional damage due to access pathways,  debris removal and equipment weight.

However, due to the fragility of items listed below and/or interference with job performance/access 318 Tree Service will not be liable for

any of the following damages that may occur during services:

  • Concrete, Brick, Pavers

  • Bushes, Hedges, Plants

  • Etc. To be Outlined in Estimate

Waiver of Liability in Storm/Catastrophic Emergency & Tree Removal From Dwelling/Structure:

318 Tree Service will make every reasonable effort to prevent any additional damage in the event of tree emergencies due to a storm or other catastrophic event. Due to time

sensitivity and heavy equipment use additional ground damage will be expected. Once a tree falls to the ground or structure in an uncontrolled manner    

it becomes very unpredictable. 318 Tree Service’s priority will be safety of crew and removal of unsecured structures may be necessary to complete tree removal.

318 Tree Service will not be liable for any additional repairs needed  to structure due to our removal process. 318 Tree Service will not be liable for any underground

system damages due to our tree removal process. Please be advised due to the tedious skill and time required to remove a fallen tree our fees are a higher hourly rate.
